Terms of service

These are the terms on which KwikOrda provides KwikOrda. The first half is the agreement with a restaurant that subscribes. The second half matters if you are ordering food, and is short, because your agreement for the meal is with the restaurant rather than with us.

What KwikOrda is

KwikOrda is software that lets a restaurant take orders through WhatsApp. We provide the ordering system, the menu, the cart, the kitchen ticket and the connection to a payment provider.

We do not sell food, cook it, or deliver it, and we never take custody of the money paid for it. Every order is a sale by the restaurant to the customer. Payments settle to the restaurant's own account at the payment provider, with our fee split out by the provider before it reaches them.

Your subscription

Getting an account

You apply, you confirm the email and phone number you gave, and we review it. We may ask for documents showing the business is yours, and we may decline an application — if we do, we will tell you why. Nothing is charged before an account exists.

Plans and payment

  • You choose a plan when you apply. The price and billing period shown at that moment are the ones that apply.
  • A free plan includes card and mobile-money collection for the trial period stated on the pricing page; after that it keeps taking orders on cash on delivery.
  • A paid plan starts when your first payment clears, and renews automatically each month or year until you cancel.
  • We charge a flat fee. We do not take a commission on your orders, on any plan.
  • If we change a price, we will tell you at least 30 days before it applies to you, and you can cancel before it does.

If a payment fails

We will retry and email you. If the invoice is still unpaid after the grace period, the account is suspended: new WhatsApp orders stop, and your menu, past orders and settings are kept. Paying the invoice puts you straight back.

Cancelling

Cancel any time from Billing. You keep the service until the end of the period you have already paid for. See the refund policy for what happens to money already paid.

What you are responsible for

  • That the food you sell is safe, correctly described, and legal for you to sell — including any licence or permit your local authority requires.
  • That your prices, allergen information and delivery promises are accurate.
  • Fulfilling the orders you accept, and dealing fairly with a customer when something goes wrong.
  • The people you give console access to, and keeping your own login secure.
  • Handling your customers' personal information lawfully. You are its controller; we process it for you. Our privacy policy sets out the split.

What you must not do

  • Use the platform for anything other than selling your own food and drink.
  • Message people who have not contacted you first, or send marketing to a customer who has not opted in.
  • Upload someone else's photos, menus or brand as your own.
  • Attempt to reach another restaurant's data, or probe the platform's security without our written agreement.

We may suspend an account immediately for any of the above, or where we are required to by law or by our payment provider. Where suspension is not urgent, we will tell you first and give you a chance to fix it.

If you are ordering food

If you are ordering food

Your contract for the meal is with the restaurant, not with KwikOrda. They set the prices, they cook it, they deliver it, and they are responsible for it.

  • An order is accepted when the restaurant confirms it, not when you send the message.
  • The price you are shown at checkout is the price, including any delivery fee stated there.
  • If something is wrong with your order, contact the restaurant. They can refund it — see the refund policy.
  • Do not use the ordering chat to send abusive, unlawful or deliberately false content. We can block a number that does.

We keep the ordering system working and the payment path honest. We do not vouch for any particular restaurant's food, timing or service.

Availability

We work to keep KwikOrda running and will give notice of planned maintenance where we can. We do not promise uninterrupted service: the platform depends on WhatsApp, on a payment provider and on mobile networks, none of which we control. An outage in one of those is not a failure we can fix, though we will always say plainly what is happening.

Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Subject to that: we are not liable to a restaurant for lost profits, lost orders or lost goodwill, and our total liability to a restaurant in any twelve-month period is capped at the fees they paid us in that period. We are not liable to a diner for the food itself — that is the restaurant's responsibility, and pointing at us instead would not get anyone's dinner fixed.

Ending the agreement

You can close your account at any time. We can end this agreement on 30 days' notice, or immediately if you materially breach these terms. If we end it without cause, we refund the unused part of what you have paid. On closure you can export your menu and order history for 30 days, after which it is deleted as described in the privacy policy.

Governing law

These terms are governed by the laws of Ghana, and the courts of Ghana have exclusive jurisdiction over any dispute. Talk to us first — write to support@kwikorda.app and give us 30 days to sort it out.

Changes to these terms

We will email restaurant account owners at least 30 days before a material change and update the date at the top. If you do not accept it, cancel before it takes effect and we will refund the unused part of the period you have paid for.
